RE: Council Motion of 3/20/07 by Councillor Caulfield
“Request the City Manager have the Building Commissioner expedite demolition of
structure at Westford and Nichols Streets”.

Regarding the above mentioned
motion, I have been in contact with Bob Camacho, Inspectional Services
Commissioner and he has stated that under Massachusetts State Building Code 780
CMR 121.0 UNSAFE STRUCTURES on March 22, 2007 this office notified the owner of
the property and he has refused to comply with either securing or removing the
structure or to allow us entrance to further evaluate.
Therefore under
780 CMR 121.4 a “Survey Board” was established and evaluated the subject
property for its structural integrity, possible injury to pedestrians and
surrounding properties. The Survey
Board’s findings are as follows:

Dangerous to life & limb, specifically unsafe in case of fire.

Open to weather

Structurally unsound
As a results of the Board’s
findings and coupled with the fact that the property owner after being notified
has failed to comply with securing, making safe or removing the structure from
the first fire in July of 2006, an order to remove the structure will be issued
forthwith.
The owner of the property
will have until 12:00 noon of the day following the service of notice in which
to begin to remove the structure.
