II.                Public Hearings

Zoning Amendment: Priority Development Sites

In accordance with M.G.L. Chapter 40A, Section 5, the Lowell Planning Board will hold a Public Hearing to hear all interested persons relative to an ordinance to amend “The Code of Ordinances City of Lowell, Massachusetts,” with respect to Appendix A thereof entitled “Zoning.”  The amendment would establish a new section 9.5 of the zoning code establishing procedural requirements for permitting developments in Priority Development Sites, as defined in M.G.L. Chapter 43D and established by the Lowell City Council.  The amendment would also designate the Hamilton Canal District as a Priority Development Site.

 

Site Plan Review: 520 Fletcher Street

The Lowell Planning Board will review an application by Merrimack River Valley House, Inc. for Site Plan Review for a project located at 520 Fletcher Street.  The proposal includes the construction of an 18,000sqft addition to an existing 17,200sqft building to update and expand the existing use on site.  The project is located on a 41,281sqft lot with 270 feet of frontage and two curb cuts along Fletcher Street.  The project is located in the TMF (Traditional Neighborhood Multi Family) zoning district.  The project requires Site Plan review under Section 11.4 of the Lowell Zoning Ordinance.

 

Site Plan Review: 612 Dutton Street, 556 Dutton Street, 51 Western Avenue, 564 Dutton Street, 62 Western Avenue, 4 Fletcher Street, and 2 Western Avenue

The Lowell Planning Board will review an application by The Westford Group, the Trustees RR Realty Trust, Dutton Street Realty Trust and Dutton Car Wash for Site Plan Review for a project located at 612 Dutton Street, 556 Dutton Street, 51 Western Avenue, 564 Dutton Street, 62 Western Avenue, 4 Fletcher Street, and 2 Western Avenue.  The project includes the demolition of an existing carwash facility and the construction of a 3,600 sqft coffee shop/restaurant space with drive thru facilities on a 20,473 sqft lot.  A ZBA Special Permit review is required for the proposed drive thru facility.  The project will be accessed via two curb cuts off of Dutton Street and is located in the LI (Light Industry/Mixed Use) zoning district.  The project requires Site Plan review under Section 11.4 of the Lowell Zoning Ordinance.

The following individuals have requested for the Planning Board to provide a preliminary review of their proposed project at the addresses listed below.  These are not public hearings.  Each project will require a public hearing as noted below.  Note:  The Planning Board renders no decision nor guarantees any future decision, whether positive or negative, on any project that receives pre-application review.  This review process is for information purposes only.

Bond Reduction Request: O’Heir Way Estates

Kazanjian Enterprise, Inc. is requesting a bond reduction for work completed to date on O’Heir Way Estates.  The Planning Board is currently holding a bond in excess of $100,000 for the completion of the work at this development.  All site work has been completed to date, except general roadway clean up, submittal of as-builts to the City’s Engineering Department, and final legal description.  The applicant is requesting the reduction of the bond to $9,000, the amount determined to complete the remaining work.
